Title insurance on new home; loan against primary residence; shares and class action lawsuits


http://www.jewishworldreview.com -- DEAR BRUCE: We are buying a new home in a subdivision that was once a farm. The subdivision is in its fifth phase, so it has been around for several years. My husband and I understand the need for title insurance on existing homes that are purchased. However, I'm not certain of its need on the purchase of a new home when the developers have already had the title evidence examined. Additionally, my husband and I plan to have an attorney perform a title search for us. Do you think that it is a wise investment to purchase title insurance on a new home? -- H.N., via e-mail

DEAR H.N.: Under almost any circumstance that I can imagine, I would recommend title insurance. The fact that the developer did an examination of the evidence doesn't necessarily demonstrate that he didn't make an error. The same thing is true if your attorney makes a search. Title insurance is one of the few types of insurance for which you make only one payment that covers you for as long as you have an interest in the property. In all of the properties that I have purchased in my lifetime, each has had title insurance placed upon it.

DEAR BRUCE: I'm thinking of purchasing a new car that will be used for business and would like to take advantage of the low interest rates and the possible tax deductions. I have a rental condo in which I have $30,000 equity. If I took out a home equity loan on the rental condo, would the interest be tax deductible? -- L.K., Cincinnati, Ohio

DEAR L.K.: If you took the loan against your primary residence, there would be no problem. However, unless the car has something to do with the condo, I would have to question the tax deductibility of the interest on that loan. Because the car is a business automobile, why not go into a rental agreement with the dealer, or take advantage of some of the great discounts that are available? Before you make your move, you should be certain that your accountant advises you on the most tax-friendly position for you.

DEAR BRUCE: I have 50 shares of stock in a company that recently had a class action lawsuit filed against it. The lawsuit was on behalf of anyone who owned or purchased stock during a certain time frame -- which I did. I have received communications from the attorneys who say that all I have to do is sign, and I'm part of the class action lawsuit. How much can I expect to receive on the small number of shares that I own? -- D.L., Detroit Lakes, Mich.

DEAR D.L.: You have neglected to tell me what the lawsuit is all about. What are the plaintiffs declaring that the company did? In the absence of that information, nobody can tell you what kind of money would be involved. If the attorneys handling the suit have contacted you, and you filled out the appropriate forms that they sent, I'm confident that you are "in." Whether or not you will make any important money in this matter is another matter.
