Rent our house or sell it?


http://www.jewishworldreview.com -- DEAR BRUCE: A friend of mine said that you have a 10-percent formula that determines whether you should sell a house or rent it out. Does it make sense to simply cover your mortgage and expenses?

We bought our house a year ago, but there were a lot of problems with it, which we are renovating now. We were told that we have to have the house at least two years before making money over closing costs. What do you think? -- S.M., via e-mail

DEAR S.M.: I think that what the people are telling you is that in order to get preferential tax treatment, you would have to live in the house as your primary residence for two years of the last five. Since you didn't live there for that period of time, you will not get this preferential tax treatment. As to the viability of renting the house out, in all likelihood you would be far better off to sell it and get on with your life, particularly since you say this home has had problems. Why keep a house with problems? It very rarely pays to do what you are considering doing. You can find a better return on your money elsewhere.

DEAR BRUCE: My daughter has a two-year lease on her car with an 18,000-mile-per-year limit, for a total of 36,000 miles. She now has over 42,000, and it's still climbing. Most of this is job-related, and she does get $350 a month for automobile expenses. I cautioned her to avoid leasing. However, she wouldn't listen. Now what can she do? -- J.N. Long Beach, Calif.

DEAR J.N.: She really does not have a whole lot of choices. She will have to exercise the purchase option when the lease has been completed. Given the amount of miles that she is racking up, I can't conceive of a situation where it would make sense for her to pay the extra mileage. She would be far better advised under almost all circumstances on a closed-end lease to pick up the car at the sale price and then dispose of it. The reason that she had a lower lease payment was because she told the leasing company that she wouldn't be driving this many miles. While that may or may not have been a good plan, the fact is that she has put herself into a corner where there really are no other options.

DEAR BRUCE: I have been asked to join an offshore investment club. You pay about $10,000 to have access to their three levels of investments, which are paying between 5 percent and 20 percent per month. They place your earnings into a Visa account in an offshore bank, and you spend the returns as you would a normal Visa card for food, gas and so forth. When I asked if taxes would be owed on the profits received, they replied that this is a gray area of the law. -- A.K., Alaska

DEAR A.K.: They may think it's a gray area, but the IRS is very much persuaded that there is nothing gray about it. First of all, I don't know what they are doing to give you a 5 percent to 20 percent per month return. It's hard for me to believe that any legitimate investment can give anyone that kind of return. Putting that aside, the IRS is targeting the offshore accounts that have used charge cards to get the money back into this country. Every year it seems that there are certain areas they really focus on, and this is one of them at the present time. I would stay away.
